Colorado Proposes Hands-Free Driving Law

By Daniel E DAngelo Esq on February 25, 2014

Drivers on cell phones

Colorado law on cellular phone use while driving may soon change. Currently, Colorado law bans drivers under 18 years old from using their cell phone while driving, and bans drivers 18 and older from texting and driving.

The Colorado House of Representatives will soon discuss new law that will make talking on your cell phone without a hands-free device illegal in Colorado. The house bill (HB 14-1225) to be introduced as currently written says that a person cannot be cited for talking on their phone without a hands-free device unless stopped for another traffic violation, the violation occurs within a school zone or maintenance, repair, or construction zone, or the violation was the cause of a traffic accident. The proposed changes will also expand current law to make it illegal to also use an application on your cell phone while driving. This change is likely meant to address a loop hole, that a person could not text and drive but technically could drive and play a game on their phone.

If passed, the law is scheduled to take effect July 1, 2014.
